General Terms and Conditions for the Tuerchen.com Advertising Programme

1. General

1.1. Türchen.com is an offer of the

hereinafter referred to as "Die Schittigs GmbH".
Under the business name "Tuerchen.com" Die Schittigs GmbH offers digital countdown calendars for self-design.

1.2. These GTC apply exclusively to the Tuerchen.com advertising programme. The general terms and conditions relating to other Tuerchen.com services are not affected by this.

1.3. The advertising programme is aimed at traders within the meaning of § 14 BGB (German Civil Code) and consumers within the meaning of § 13 BGB, legal entities under public law or special funds under public law.

1.4. Any general terms and conditions introduced by the Client that deviate from, supplement or conflict with these general terms and conditions shall not become part of the contractual relationship; the performance of a service without objection shall not constitute agreement to the inclusion of other general terms and conditions.

2. Advertising programme

2.1. Clients have the opportunity to generate an advertising link on Tuerchen.com under https://tuerchen.app/en/affiliate. Clients can use the advertising link to recruit other third parties to register on Tuerchen.com.

2.2. If a person who has been recruited by a client via such an advertising link orders a paid bundle from Tuerchen.com within 6 months of the registration of third parties as a client, the client who has recruited the person shall receive a commission amounting to 6% of the turnover that Die Schittigs GmbH earns from the orders of the newly recruited client, less all applicable taxes.

2.3. Clients can request payment of the commission at https://tuerchen.app/en/affiliate. If clients have not deposited any account data, the communication of account data is a mandatory prerequisite for payment. Payment shall be made at the end of the respective quarter.

2.4. Each advertising link is valid for a period of six (6) months. Clients can generate a new advertising link at any time under https://tuerchen.app/en/affiliate.

3. Exclusion from the advertising programme

3.1. Clients are prohibited

a) to send the Advertising Link to third parties without the consent of the respective third party;
b) to send the Advertising Link to third parties in breach of the GDPR;
c) to send the Advertising Link as part of mass or serial e-mails;
d) use Google Ads and Microsoft Advertising to promote the use of the respective Advertising Link.

3.2. Clients who violate section 3.1 of these terms and conditions shall be excluded from the advertising programme and shall lose any claims to payment of commissions. Die Schittigs GmbH shall be entitled to terminate any existing contracts with the client violating clause 3.1. immediately and without notice.

4. Miscellaneous

4.1. These general terms and conditions shall be governed by German law to the exclusion of the provisions of international private law and the UN Convention on Contracts for the International Sale of Goods.

4.2. The place of jurisdiction for all disputes arising from and in connection with this contract shall be the competent court at the registered office of Die Schittigs GmbH, insofar as the client is a trader or a legal entity under public law or a special fund under public law or has no general place of jurisdiction in Germany.

4.3. Should any provision of this contract be or become void, invalid or unenforceable in whole or in part, this shall not affect the validity and enforceability of all remaining.
